McFly Supercity operates this website and respects the security and privacy concerns of users of this all its websites. We are notified under the Data Protection Act 1998 and comply with the Act in all our dealings with your personal data.
By using the website you agree to the terms of this privacy policy. As a general rule, no personal information (i.e. name, address, telephone number, e-mail address) is automatically collected from users of this website. However, there may be circumstances in which users voluntarily supply such information and in this event, any such information will be kept secure and confidential and will be used only for those purposes made known to users at the time the information is collected, or for the purposes specified in this Privacy Policy. We will also add your registered email address and personal details to our database if you register for updates from McFly Supercity via Facebook. We follow strict security procedures for the storage and disclosure of information you have given us in order to prevent unauthorised access.

OUR USE OF INFORMATION AND PERSONAL DATA
The information collected is used to provide users with information on McFly and the Supercity, in order to customise the user's online experience and to improve the content of the website. Other uses of this information include the internal review of the web pages visited, tracking the progress and number of entries in promotions and contests, tracking the number of users of the site and where appropriate, product purchased through the site. If at any time you wish to stop receiving information you can opt out or reply 'Stop' to any e-mail you receive from us. You can also opt out of any SMS communications you receive from us. It may be necessary from time to time for data to be transferred from the point of collection to a server located in another jurisdiction. Information will only be so transferred in circumstances where it is necessary to achieve the purposes set out in this Privacy Policy or the purposes made known to users at the time information is collected. No matter where your information is processed, this privacy policy will remain in effect.
USE BY CHILDREN
If you are under the age of 16 you should obtain the consent of your parents or legal guardians for submitting any personal information to this Website.
Children under the age of 13 should not submit any personal information without the written consent of their parents or legal guardian. Each time you visit the website, the server may deliver certain customised information to your computer based on the data stored in your cookie. This allows the us to tailor the service to your preferences. You are not obliged to accept a cookie and you may modify your browser so that it will not accept cookies. If you wish to purchase any items on the Website you need to ensure that cookies are enabled. If, however, you do not want to accept cookies please use the help tools provided with your internet browser to find out how to achieve this.
We never use cookies to retrieve information from your computer which was not originally contained in the cookie. We use cookies and IP addresses for system administration and to monitor aggregate non-personalised information (such as anonymous statistics related to the take up or use of services, or to patterns of browsing). Certain non-personal information about users is recorded by the standard operation of the Supercity's internet servers. Examples of this type of information include the type of browsers being used, its operating system and the domain names (not e-mail addresses, where possible) of users.
FORUMS
While the administrators and moderators of our forums will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. Therefore you must acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster (except for posts by these people) and hence will not be held liable.
We ask that you agree to not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions. You agree that the webmaster, administrator and moderators of the forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.
Our forum system uses cookies to store information on your local computer. These cookies do not contain any of the information you enter on this form; they serve only to improve your viewing pleasure. The e-mail address you enter will be used for confirming your registration details and password (and for sending new passwords should you forget your current one). When you register to use and to post comments on the Supercity you will also be signed up to receive updates about new releases, preferential ticket purchase opportunities, PA's, exclusive competitions and music downloads from the artist. The first email you will be sent will contain your username and password plus a confirmation link. If you are happy to receive the updates just click on the confirmation link within that email, if you do not click on that link you will not receive updates via email from the site.

PASSING INFORMATION TO THIRD PARTIES
We do not pass your details to third parties for the purposes of allowing them to market their products or service to you, UNLESS you have ticked the third party box on our registration forms giving us permission to do so. We may however market third party products or services that are expressly connected with the relevant artist, such as ring-tones. We may also, occasionally include advertising for third party products or services on the website, or in newsletters or other artist mailings you receive from us.
FINANCIAL
We may use your financial information (including credit card transactions) to check your qualifications and Bill you for and otherwise facilitate your purchase of products and services. When you make a purchase on the Site, we will provide your financial information (including credit card transactions) to our service providers and to such third parties as we determine is necessary to process your transactions. These third parties may include the credit card companies and banking institutions used to process the transaction. Also, depending on the circumstances of our arrangements, we may share your financial information (including credit card transactions) with applicable Event Partners, primarily but not exclusively for facilitating "will call" ticket pick up and dispute resolution and customer service at the event venue on the date of the event. When you purchase products or services of third parties (such as magazine subscriptions) offered on the Site, we will provide your financial information (including credit card transactions) to those third parties. Any of these various third parties are authorised to use your financial information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control.
HOW WE USE AND WHEN WE SHARE BROAD DEMOGRAPHIC INFORMATION
We may use, and may transfer to others to use, broad demographic information that may include data from your activity at the Site, but not personal information. For example, we use broad demographic information to tailor the site to the interests of our visitors, and we may share it with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. DISCLOSURE
If you are a member of the artists community you should note that when you complete your member profile this information can be viewed by other members. Accordingly you should not provide any information in your member profile that you do not wish to share with third parties and you should have no privacy expectations with respect to the information contained within it. You should be aware that if you voluntarily disclose information online in a public accessible area, such as in your member profile, a message board or chat room, that information may be collected an used by others. We do not control the actions of our visitors. If you disclose personal information in your member profile message board or any other public accessible place on the internet you do so at your own risk and should understand that your submitted information may be collected and used by others to send you unsolicited messages, advertisements, or for other purposes. Please remember the protection of your privacy begins with you. You are solely responsible for maintaining the secrecy of any password you use to register, and you should always be careful and responsible whenever disclosing information online.
GENERAL
We may make changes to this privacy policy from time to time but will not change the way we use your information provided previously without your express consent.
If any provision of this privacy policy is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced. Universal's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
This privacy policy is governed in all respects by the laws of England and Wales. Legal proceedings related to the matters set out in the Privacy Policy shall be brought in and adjudicated solely in the courts of England and Wales.
SUBSCRIPTION
McFly Super City has a recurring payment subscription service for Monthly memberships where as Annual memberships are one off payments made at time of purchase. By agreeing to these terms and conditions, you are authorizing Super City to charge your authorized PayPal account or Visa, Mastercard, Visa Debit, Maestro, Solo Card for the specified amount of either £45/$69 per Annum OR £6/$9 for monthly payments OR £65 for an Annual Plus, dependant on what package you select on the following pages.
The Merchant Company (Sandbag Ltd) will advise you of the amount to be paid and the dates on which payment is due and the Merchant & Co. Ltd may only change these amounts by giving you prior notice. Should you wish to cancel your subscription, please visit the Manage My account Area within your profile on Super City and select Cancel My Subscription. You will receive an email notification of this and the recurring payment will cease. Annual Subscription If you are resident in the UK and Europe this will cost you £45 per annum or, if you are anywhere else where we allow you to register with the Super City (see the list of countries here [insert link]), this will cost you USD$69 per annum.Monthly Subscription
If you are A resident in the UK and Europe this will cost you £6 per month or, if you are anywhere else where we allow you to register with the Super City, this will cost you USD$9 per month. This is a recurring payment subscription and this means that monies will be deducted from your account every month. If for whatever reason payment is declined or unsuccessful, you have one week's grace period to make successful payment, else your account will automatically be made a basic account with basic access until you make a successful payment once again.
Renewing and Cancelling Your Subscription
Annual Subscription and Monthly Subscriptions must be paid by you in advance. You can cancel your Annual Subscription or Monthly at any time by going into "Manage My Account" and clicking "Cancel My Subscription", but you will not be refunded any money for the remaining period you have not used.
Expiry of Your Subscription
Please remember that if you do register with the Super City, and then the card details you provided are declined, Super City will offer a grace period of 7 days from when your registration expired to make payment. If payment is not successfully taken you will lose all that you have created or benefitted from as a registered user.
THE SHOP
Generally
As well as Annual Subscriptions and Monthly Subscriptions, the Super City contains an online store with all kinds of products you may want to purchase. The products contained within the online store include:
Physical products, like CDs, DVDs, merchandise and concert tickets.
(together the "Products"). To purchase Products from the Super City you must:- be legally capable of entering into binding contracts;
- be either over 18 or, if you are under 18, have the prior permission of your parent or guardian to purchase the Products; and
- resident in one of the countries that we deliver to
- Please note if you come to the Super Store directly and not via Super City - You will need to login to get your Citizen Store discount. If you enter the store via Super City, your relevant discount will automatically be applied. If you are buying Products from the Super City Super Store, we will ask you to confirm that your order is correct before you proceed to the checkout.
If it is not correct, you can revisit your order and correct the mistakes before confirming and submitting your order to us. It is your responsibility to ensure that your order is correct before submitting it to us. If you have any problems with your order, please contact mcfly@sandbag.uk.com.
When you submit your order, you are offering to buy the Products at the price set out in the order. We will acknowledge receipt of your order by email. This is not an acceptance of your order. Our Contract is not made until we confirm that we have accepted your order, which we will do when we email you an order confirmation form.
If, when we acknowledge receipt of your order, you discover you have made a mistake with your order please contact [mcfly@sandbag.uk.com or call +44 (0)1189 9569183 immediately. Please do this before we confirm that we have accepted your order. We may be unable to rectify mistakes after we have sent you the order confirmation form, although you may still have the right to cancel described below.
We check the prices on the Super City Super Store regularly. However, if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed.
If the Products that you have ordered are no longer available, we may:
- to the extent that the Product is not a Downloadable Product, offer you substituted Products of a similar nature and quality. In this case, we will contact you and ask if you wish to proceed. If you do not want to keep the substituted Products, you can cancel your order as set out below, and we will pay for the cost of returning the Products;
- to the extent that the Product is a Downloadable Product, your sole remedy will be a refund of the price you have paid for the particular Downloadable Product that is no longer available.
- In both cases, if you confirm that you do wish to proceed, please remember that we will still not be under an obligation to supply the Products until we have confirmed that we have accepted your order.
